Terms and Conditions of Sale
Preamble
These General Terms and Conditions of Sale and Use (hereinafter referred to as the "Terms & Conditions") apply between, on the one hand:
Chauss Service,
SAS with a share capital of €1,000,000,

registered with the Trade and Companies Register of Rodez under number 412 651 481,
NAF code: 46.42Z
EU VAT number: FR06 412 651 481,
publisher of the website www.soiretmatin.fr,
and owner of the brand Soir & Matin,
(hereinafter referred to as “Chauss Service” or “the Company”),
and on the other hand,
any person making a purchase on the website www.soiretmatin.fr,
(hereinafter referred to as “the Customer”).
Chauss Service reserves the right to modify these Terms & Conditions at any time by publishing a new version on the Website.
Placing an order implies full, unconditional acceptance of these Terms & Conditions by the Customer, which take precedence over any other document.
The sales contract is governed by French law.
Article 1: Orders
The offers on the Website are intended exclusively for consumers with a delivery address in countries where Chauss Service provides shipping through its logistics partners.
Products are offered within the limits of available stock.
In the event that a product ordered becomes unavailable, Chauss Service undertakes to:
• inform the Customer by email,
• refund the Customer within a maximum of 14 working days if payment has already been received.
Chauss Service reserves the right to cancel any order from a Customer with whom there is an existing dispute concerning a previous order.
1.a) Accuracy of Information and User Conduct
This clause legally binds the Customer to:
• provide truthful and accurate information (address, identity, payment details);
• not impersonate another person or disrupt the Website;
• express themselves respectfully in reviews or messages (and authorize Soir & Matin to remove any offensive, defamatory, abusive or promotional content).
1.b) Accuracy of Information and User Behavior
The Customer agrees to provide complete, accurate, and up-to-date information when placing any order, creating an account, or communicating with Soir & Matin.
Any false or fraudulent information may result in order cancellation and/or account suspension, without prejudice to possible legal action.
The Customer agrees to behave respectfully across all communication channels of the brand (website, social networks, product reviews, customer service).
Soir & Matin reserves the right to delete any comment or content deemed unlawful, immoral, or damaging to its image or that of third parties (defamatory, hateful, vulgar, or promotional content, etc.).
2. Right to Refuse, Suspend or Cancel an Order
Soir & Matin reserves the right to refuse any order from a Customer for legitimate reasons, including:
• existing disputes regarding previous orders;
• payment authorization refusal by financial institutions;
• abnormal or bad-faith orders;
• or any suspicion of fraud.
Soir & Matin also reserves the right to modify or cancel an order in the event of:
• a clear pricing or description error;
• product unavailability;
• or exceptional circumstances making the sale impossible (force majeure, logistical breakdown, etc.).
In such cases, the Customer will be notified by email and fully refunded as soon as possible.
4. Prohibited Use of the Website
The Customer agrees not to use the website www.soiretmatin.fr for any illegal or prohibited purpose under French or European law, or in a manner that could harm Soir & Matin, its partners, or third parties.
In particular, the following are strictly prohibited:
• unauthorized collection of personal data;
• attempted unauthorized access to the site’s servers;
• use of bots or scripts that could disrupt the operation of the Website;
• dissemination of malicious or defamatory content.
Any breach may result in immediate suspension of the Customer’s account and removal of Website access without prior notice.
Article 2: Products
The products offered for sale are described and presented as accurately as possible.
However, minor differences may occur between product photos and the final product (color tone, texture, or details due to artisanal manufacturing).
Chauss Service reserves the right to make any necessary modifications to its products without altering their quality or overall appearance.
Article 3: Prices
Prices displayed on the Website are expressed in euros (€), including all taxes (VAT included), and exclude shipping and packaging costs or any other additional costs that may arise.
Shipping and delivery fees or any other additional costs are specified during checkout.
Prices may be changed at any time without prior notice, but products will be invoiced at the rate in effect at the time the order was placed.
In the event of an obvious pricing error, the Company reserves the right to cancel the order.
Article 4: Payment
Products must be paid in euros (€).
Accepted payment methods include:
• Credit or debit card (Visa, Mastercard, Amex)
• Google Pay
• Apple Pay
All goods remain the property of Chauss Service until full payment is received.
Risk transfers to the Customer upon delivery.
Article 5: Acceptance of the Offer
Placing an order on the Website constitutes express and irrevocable acceptance of the prices and product descriptions available for sale.
Order validation by the Customer constitutes acceptance of these Terms & Conditions.
Article 6: Invoicing
An invoice is sent to the Customer by email to the address provided at checkout.
It is issued according to the prices applicable on the date of the order.
Chauss Service cannot be held responsible for any entry error attributable to the Customer.
Article 7: Shipping and Delivery
A. Shipping
Orders are usually prepared within 1 to 3 business days, excluding weekends and public holidays.
This period may be extended during peak periods (sales, holidays, new collection launches).
B. Delivery Times
Delivery times vary depending on the destination and chosen shipping method :
- Express delivery within 24-48 hours (mainland France)
- Standard delivery within 3 to 6 business days (mainland France)
Chauss Service makes every effort to meet delivery deadlines but cannot be held responsible for delays caused by carriers, customs, or force majeure events.
C. Delivery Costs
Free delivery to pickup points in mainland France (Mondial Relay or equivalent) from 35€.
Express home delivery: variable rate depending on weight and carrier.
Transport risks pass to the Customer once the parcel is handed over to the carrier.
The Customer must check the condition of the package upon receipt and report any anomaly within 48 hours to: contact@soiretmatin.fr
Article 8: Return and Refund Policy
The Customer may return a product under the conditions defined below.
1. Eligibility Conditions
To be accepted for return, the product must be in commercially acceptable condition, meaning:
- not worn under normal use,
- not used,
- not washed,
- not damaged,
- returned in its original packaging with all accessories and tags.
Any product not meeting these conditions will be refused and sent back to the Customer without refund or exchange.
2. Return Fees
Returns for refund are at the Customer’s expense, with a flat rate of €3.00 in mainland France.
All returns from outside mainland France are entirely at the Customer’s expense, including shipping, transport, customs or any related costs.
This amount will be automatically deducted from the refund.
Return costs are covered only in case of an error attributable to Chauss Service (incorrect item, visible defect, etc.).
3. Refund
The refund will be made within 14 days after receipt and inspection of the product.
Refunds are processed via the original payment method.
In case of a non-compliant return, no refund will be issued.
Article 9: Right of Withdrawal
In accordance with Articles L221-18 and following of the French Consumer Code, the Customer has 14 calendar days from receipt of the order to exercise the right of withdrawal, without providing justification or incurring any costs other than those provided by law.
1. Exercising the Right of Withdrawal
To exercise this right, the Customer must notify Chauss Service before the legal deadline by email at: contact@soiretmatin.fr
2. Product Return Conditions
The product must be returned within 30 calendar days following notification of withdrawal.
The slippers must be returned in commercially acceptable condition:
- not worn under normal use,
- without signs of wear (especially on the sole),
- not washed or damaged,
- in original packaging with all accessories and tags.
The Customer may try on the slippers as in-store, but excessive use making the product unsellable may lead to refusal of return.
3. Return Fees
Return costs are borne by the Customer, in accordance with Article L221-23 of the French Consumer Code.
- For mainland France: flat fee of €3.00, deducted from the refund.
- For returns from outside mainland France:
all shipping, transport, customs and other related costs are entirely at the Customer’s expense.
Return costs are covered by Chauss Service only in the event of an error attributable to the Company (incorrect item, visible defect, etc.).
4. Refund
Chauss Service will refund all amounts paid, including initial standard delivery fees, within a maximum of 14 calendar days from receipt of the returned product.
The refund will be made via the original payment method used when ordering.
In case of a non-compliant return, no refund will be issued.
Article 10: Obligations of the Parties
Chauss Service undertakes to deliver products in compliance with applicable French and European regulations.
The Customer agrees to:
• provide accurate and up-to-date information (address, contact, payment details);
• accept delivery at the address provided;
• bear reshipping costs in case of incomplete or incorrect address.
Article 11: Miscellaneous Provisions
If any clause of these Terms & Conditions is found invalid, the remaining provisions shall remain in full force.
Neither party shall be held liable for non-performance in cases of force majeure (strike, war, fire, natural disaster, pandemic, etc.).
Article 12: Promotions and Commercial Offers
Promotional offers and sales campaigns are valid while stocks last and within the dates specified on the Website.
In case of partial return of an order containing a promotional item, the applied discount will be recalculated accordingly.
Article 13: Applicable Law and Dispute Resolution
These Terms & Conditions are governed by French law.
In the event of a dispute, the Customer is invited to contact Soir & Matin’s Customer Service at contact@soiretmatin.fr.
Pursuant to Article L.612-1 of the French Consumer Code, any consumer has the right to free access to a consumer mediation service.
Failing an amicable agreement, disputes shall be submitted to the competent courts of the jurisdiction where Chauss Service’s registered office is located.
